This website is operated by Oak Mercer. Throughout the site, the terms "we",
"us" and "our" refer to Oak Mercer. By visiting our site or purchasing
something from us, you agree to be bound by these Terms of Service, including
the additional terms and policies referenced here and available by hyperlink.

If you do not agree to these terms, you should not use this site or place an
order.

We may update these terms at any time by posting a revised version on this
page. It is your responsibility to check this page for changes. Continued use
of the site after a change means you accept the revised terms.

ONLINE STORE TERMS

By agreeing to these terms, you confirm that you are at least the age of
majority in the place you live, or that you have given consent for any minor
dependent to use this site.

You may not use our products for any illegal or unauthorized purpose, and you
may not, in using the service, violate any law in your jurisdiction, including
copyright law.

You may not transmit any worms, viruses or code of a destructive nature. A

PRODUCTS, PRICING AND AVAILABILITY

Products are offered subject to availability. We may limit the quantity of any
product we offer and may discontinue any product at any time.

All prices are shown in United States dollars and may change without notice.
We reserve the right to refuse or cancel any order, including an order placed
against a price that was listed in error. If we cancel an order you have
already paid for, we will refund you in full.

PRODUCT IMAGES AND DESCRIPTIONS

We work hard to describe and picture every product accurately. Some of the
images on this site are styled lifestyle photographs created to show how a
piece can be used in a room. They are illustrative, and props, plants,
furniture and settings shown alongside a product are not included unless the
product description says so.

Colour, grain, glaze and finish vary between screens and between individual
pieces, particularly in solid wood and fired ceramic. We do not warrant that
the colour on your screen will match the item exactly.

Measurements listed on a product page are approximate.

ORDERS AND ACCOUNT INFORMATION

You agree to provide current, complete and accurate purchase and account
information for every purchase. You agree to update your information promptly
so that we can complete your order and contact you if needed.

We reserve the right to refuse any order. We may limit or cancel orders that
appear to be placed by dealers, resellers or distributors, or that appear
fraudulent.

PAYMENT

Checkout is hosted and secured by Shopify. Your full card details are handled
by Shopify and its payment processors and do not reach us directly. By placing
an order you authorize us to charge your chosen payment method for the total
shown at checkout.

SHIPPING AND TITLE

We ship within the United States only. Shipping timescales quoted anywhere on
this site are estimates, not guarantees, and do not account for delays caused
by carriers or events outside our control.

Risk of loss and title for items pass to you on delivery to the carrier,
unless stated otherwise at checkout.

Shipping is governed by our Shipping Policy, which forms part of these terms.

RETURNS

Returns and refunds are governed by our Return and Refund Policy, which forms
part of these terms.

INTELLECTUAL PROPERTY

All content on this site, including text, product descriptions, photographs,
graphics, logos and page design, is the property of Oak Mercer or its
suppliers and is protected by applicable intellectual property law. You may
not reproduce, distribute or create derivative works from it without our
written permission.

THIRD PARTY LINKS

Some content and services available through this site may include material
from third parties. Third party links may direct you to sites that are not
affiliated with us. We are not responsible for examining or evaluating their
content and we are not liable for any third party materials or websites.

DISCLAIMER OF WARRANTIES

timely, secure or error free, and we do not warrant that the results obtained
from the use of the service will be accurate or reliable.

Except as expressly stated by us, the service and all products delivered to
you through the service are provided as is and as available for your use,
without any representation, warranties or conditions of any kind, either
express or implied.

Nothing in these terms limits any statutory rights you have as a consumer that
cannot be excluded under applicable law.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, Oak Mercer shall not be liable for any
indirect, incidental, punitive or consequential loss arising from your use of
the service or any product purchased through it.

Where liability cannot be excluded, our total liability to you is limited to
the amount you paid for the product in question.

INDEMNIFICATION

You agree to indemnify and hold harmless Oak Mercer and its officers,
employees, contractors and suppliers from any claim or demand, including
reasonable legal fees, made by any third party due to your breach of these
Terms of Service or your violation of any law or the rights of a third party.

SEVERABILITY

If any provision of these terms is found to be unlawful or unenforceable, that
provision shall be severed and the remaining provisions remain in full force.

GOVERNING LAW

These Terms of Service are governed by the laws of the Commonwealth of
Pennsylvania, United States, without regard to its conflict of law provisions.
